As discussed in the latest main-page entry, Attorney General-designate Alberto Gonzales, in his written responses to questions propounded by the Senate Judiciary Committee, argues that the International Convention Against Torture does not apply to aliens captured overseas:
When the Senate ratified the treaty, it defined such treatment as violations of the Fifth, Eighth and 14th Amendments. Because of that provision, Gonzales said, the Justice Department decided that the convention applies only to actions under U.S. jurisdiction, not "treatment with respect to aliens overseas."
Any lawyer with a knowledge of the relevant documents would understand that what Gonzales is arguing is patently false. Thus, he's either incompetent or deliberately misleading; either way, he's unfit to be AG. More below the fold...
